North American group sets Bangladesh factory safety plan

CHICAGO/WASHINGTON (Reuters) - North American retailers unveiled a five-year safety plan for Bangladesh garment factories on Wednesday that would include inspecting within a year every factory they use, following tragedies such as April's deadly garment building collapse.

The North American plan was immediately criticized by groups that think a European-led plan is stronger.

The plan announced in Washington, D.C. by the Alliance for Bangladesh Worker Safety, which includes 17 retailers and apparel companies, comes after 1,129 workers were killed in the collapse of a Bangladesh garment plant in April, and another 112 people perished in a fire at a Bangladesh factory in November.

A larger number of mainly European retailers that have signed what is known as the Accord on Fire and Building Safety in Bangladesh announced a similar plan on Monday. [ID:nL5N0FB2IK] Both plans include factory inspections, worker training and ways for workers to report safety concerns. The two groups also agreed not to use factories considered to be unsafe.

Members of the Interfaith Center on Corporate Responsibility and long-term shareholders in apparel brands and retailers said the Alliance's plan lacks sufficient worker protections and accountability mechanisms and called it a weaker alternative to the European-led accord.

European unions involved in the other accord, industriALL and UNI Global Union, called the North American alliance "another toothless" auditing program.

"This initiative is not serious," said Tom Grinter, a spokesman for industriALL.

MORE THAN 500 FACTORIES TO BE INSPECTED

More than four million people, mostly women, work in Bangladesh's clothing sector, making it the second-largest global apparel exporter behind China.

The North American alliance plans to inspect the more than 500 factories its members get garments from within a year, while the European-led accord plans to have initial inspections at the factories its 70 members use within the next nine months.

"I think both plans are very strong and that we should work together going forward," said Jay Jorgensen, Wal-Mart Stores Inc's global chief compliance officer. "Theirs doesn't recognize the way the U.S. legal system works, which is why the vast majority here in the U.S. didn't join."

One of the main concerns North American parties had with the European-led accord was the use of a binding arbitration process that would be enforceable in the courts of the country where a company is domiciled. Binding arbitration typically restricts the ability of the parties involved to appeal any decision in court.

North American alliance members will be held legally accountable to the group. If they do not do the work they agreed to do, the board can kick members out, their funds will be kept by the alliance and companies can arbitrate to get back in, said Jorgensen, a member of the alliance's nine-member board of directors.

Daniel Duty, Target Corp's vice president of global affairs who is also on the alliance's board, said that between the efforts of the alliance and the accord, the groups should be able to cover the majority of the factories in Bangladesh, more than the 500 the North American alliance plans to inspect.

Bangladesh's Ambassador to the United States Akramul Qader welcomed the North American plan and said he was "glad that alliance members have expressed (their) intention to collaborate with the EU-based accord on fire and building safety."

He also expressed hope the United States would quickly restore trade benefits that were suspended in late June because of the poor safety conditions in Bangladesh.

The U.S. decision set duties on about $35 million worth of ceramics, golf equipment, tobacco products and other goods from Bangladesh that previously entered the United States duty free.

The U.S. move does not directly affect Bangladesh's multi-billion-dollar clothing exports, since garments are not eligible for U.S. duty-free treatment.

1O PERCENT EARMARKED TO ASSIST WORKERS

So far, $42 million has been raised for the North American project. Companies will contribute up to $1 million a year for five years based on how much they produce in Bangladesh.

Ten percent of the funds will be set aside to assist workers temporarily displaced by factory improvements or if a factory closes for safety reasons. The money will also support a non-governmental organization to be chosen within 30 days that will implement parts of the program.

The North American alliance's plan, called the Bangladesh Worker Safety Initiative, was developed with assistance from former U.S. Senators George Mitchell and Olympia Snowe, who acted as independent facilitators at the Bipartisan Policy Center, a Washington-based think tank. The alliance has asked Mitchell and Snowe to verify the effectiveness of the program over at least the first two years.

The 17 current members of the alliance include: Canadian Tire Corp Ltd ; Carter's Inc ; The Children's Place Retail Stores Inc ; Gap Inc ; Hudson's Bay Co ; IFG Corp; J.C. Penney Co Inc ; Jones Group Inc ; Kohl's Corp ; L. L. Bean Inc; Macy's Inc ; Nordstrom Inc ; Public Clothing Co; Sears Holdings Corp ; Target; VF Corp ; and Wal-Mart.

Hong Kong sourcing company Li & Fung Ltd , which does business with many of the companies involved, is serving as an adviser. Additional members are expected to join.

The North American alliance's plan is also being backed by the American Apparel & Footwear Association, Canadian Apparel Federation, National Retail Federation, Retail Council of Canada, Retail Industry Leaders Association, and the United States Association of Importers of Textiles & Apparel.

Signature check circumvention allows free tethering without a jailbreak

An interesting security hole has been discovered that allows people to circumvent iOS Carrier.plist file checks by creating, modifying, and restoring a backup file. The example presented iTweakiOS uses the hack to enable tethering without having to go through a carrier.

The iOS Carrier.plist file is responsible for a number of carrier related-settings, including device tethering. iTweaksiOS modified the value of the cellular gateway used for tethering so data could be directed to go through the gateway used for normal device traffic instead.

CommCenter, the iOS service responsible for handling network connectivity, normally performs a signature check on the Carrier.plist to ensure it has not been tampered with. However, modifying it on a backup file and then restoring the modified backup worked to circumvent the check. While it is unclear why it's possible to get around the signature check this way, it seems likely that Apple will fix this with the public release of iOS 7 this fall.

(In case anyone is tempted to try the hack in the meantime, be warned that carriers have been known to start billing users for tethering if they suspect you of tethering illicitly.)

EU proposes centralized plan to close failed banks

BRUSSELS (AP) ? The European Union's executive branch in Brussels has proposed giving itself far-reaching powers to decide what happens to banks that need rescuing, a key part of a plan to restore confidence in the region's financial system.

Under the proposal detailed Wednesday, the EU Commission would act to rescue or wind down a bank, but only after hearing advice from a board consisting of the European Central bank, its own officials and national authorities.

Based on that recommendation, "or on its own initiative, the Commission would decide whether and when to place a bank into resolution," a Commission statement said.

Some see it as another move by the EU authorities in Brussels to erode member countries' national sovereignty and the proposal is likely to run into opposition from Germany and others.

Lithuanian President Dalia Grybauskaite, who holds the EU's rotating presidency, said in a reaction it would be a "challenge" for the EU nations to find common ground on the issue.

The common rules for a centralized approach would replace the current national strategies, where local banking regulators have often proved not to be forceful enough in dealing with their home banks.

The EU Commission's president, Jose Manuel Barroso, said that with the new proposal "it should be banks themselves, and not European taxpayers, who should shoulder the burden of losses in the future."

Since the cost of savings banks can overwhelm individual governments' finances ? as happened in Ireland and Cyprus, for example ? the Commission said strong unified action is necessary.

The central authority to solve banking crises is one of three pillars in a broader 'banking union' that the EU is trying to create. The other two are centralized banking oversight ? to be adopted by the ECB ? and a jointly guaranteed deposit insurance, which has yet to be agreed on.

The Commission indicated it proposed taking the lead role in solving banking crises because of legal constraints on other institutions.

In a statement, it said "the Commission has the necessary experience on bank restructuring" and added that it was "the best placed among EU institutions to ensure that final decisions fully respect the principles underpinning the functioning of the EU."

The Commission insisted national authorities and the ECB would have a key role in leading the Commission's actions.

CLEVELAND (AP) ? The Cleveland Cavaliers are taking a chance on Andrew Bynum and his creaky knees.

The free agent center, who never played one second with Philadelphia last season because of knee injuries, has agreed to terms on a two-year contract with the Cavs, a person familiar with the negotiations told The Associated Press.

Bynum accepted the deal on Wednesday night, said the person who spoke on condition of anonymity because the team has not announced the agreement.

The 7-footer was traded to the 76ers last summer as part of a four-team blockbuster. Bynum, a former All-Star with the Lakers, was expected to help Philadelphia contend, but the 25-year-old never stepped on the court and underwent surgery on both knees in March.

The Cavs, who beat out Atlanta and Dallas for Bynum, are only guaranteeing $6 million and one year to Bynum, the person said. The team has an option on the second year.

In Cleveland, Bynum will be reunited with Cavs coach Mike Brown. The two spent one season together in Los Angeles and Bynum had his best season as a pro, averaging 18.7 points and 11.8 rebounds in 60 games.

Bynum, if healthy, should move the Cavs from one of the Eastern Conference's worst teams to a playoff contender. Cleveland won just 24 games last season and has won 66 in the three years since LeBron James left.

Bynum has plenty of playoff experience and he would give the Cavs another proven star to go along with All-Star point guard Kyrie Irving.

In guaranteeing Bynum only one year, the Cavs have an out if he doesn't perform up to expectations. But if he does play well, the Cavs will have a roster that could attract another high-profile free agent next summer, when James could be available.

Florida man charged in Seattle with fire bomb

SEATTLE -- A Florida man suspected of an arson attack on a Seattle home has been charged with possession of a destructive device.

The U.S. attorney's office says the 53-year-old Margate man, Sang Ngoc Ung, came to Seattle threatening family members over a $20,000 debt.

He's suspected of setting fire to a home in the early morning hours of June 10, forcing a family to flee through a window. Shortly after, fire investigators went to a second home associated with the family and found a destructive device that had failed to ignite. Ung is charged in connection with that device.

He was arrested Monday by Seattle police and agents with the Bureau of Alcohol, Tobacco, Firearms and Explosives. He was scheduled to make his first court appearance Tuesday in federal court.

Witness: Fire was doused on train before it hit Quebec town

The runaway train carrying crude oil that derailed in a Quebec town, killing at least 13 people and leaving dozens of others unaccounted for, was tampered with in some way, the company's chairman claimed in an interview published Monday.

Two days after the train derailed on a curve at 1 a.m. ET Saturday in the small town of Lac-M?gantic, creating an enormous fireball that all but incinerated six city blocks, police said at a news conference Monday that they had found eight more bodies, bringing the known number of deaths to 13. About 40 people remain unaccounted for, they said.

Police gave few details at the news conference. Earlier, authorities confirmed that the 72-car train's black box data recorder has been recovered and could give some clues as to why it began to roll seven miles downhill and crash into the town.

Canadian Transport Minister?Denis Lebel said the locomotive suspected of breaking loose and causing the derailment had been inspected just the day before, on Friday, was found to have "no defects."

"If somebody violated regulations, after the investigation is completed we will take all measures allowed by the law," Lebel said.

Ed Burkhardt, chairman of Montreal, Maine & Atlantic, the railway that operated the train, said he was certain someone tampered with the locomotive,?The Montreal Gazette reported?in an article it published Monday afternoon. The newspaper said it interviewed Burkhardt by phone from Chicago.

"We have evidence of this," he said, according to the Gazette. "But this is an item that needs further investigation. We need to talk to some people we believe to have knowledge of this."

Burkhardt didn't say what evidence the company had, other than to say he didn't believe the derailment was malicious. He said the railway had launched its own internal investigation.

"I don't like hearing statements that we don't have people there," when in fact, the railway has a dozen employees in Lac-M?gantic and has been asking for a meeting with the city's government since Saturday, he told the Gazette.

Lac-M?gantic Mayor Colette Roy-Laroche said she would be meeting with representatives from the railway for a first time later in the day.

Police said Monday?that they couldn't rule out that a "third party" was responsible, adding that they had more than 100 officers involved in an active criminal investigation.

The explosion and fires also forced more than 2,000 local residents from their homes.?About 1,500 could be able to return home Tuesday, authorities said.

Much of the scene remained off limits more than two days after the derailment. Firefighters said the hot-white blaze left a scene of destruction like nothing they'd ever before encountered.

"In my 32 years in the fire business, I've never seen devastation like this," said Tim Pellerin, chief of the Rangeley, Maine, Fire Department, one of many northeastern U.S. agencies contributing to the containment effort.

"Six city blocks have been devastated, destroyed and burned," Pellerin told NBC affiliate WLBZ in Bangor, Maine. "It virtually burned the tar in the city street.

"Even the pavement burned. The streets have been turned to dirt [because] there was so much heat."

The Quebec coroner's office said the fire was so intense that some or most of the 40 people still unaccounted for could have been instantaneously vaporized, the Gazette reported. It could be years ??if ever ? before all of the victims are identified.
