    Why Don't Fitness Magazines Put Black Women On Their Covers ...

    I startled both my husband and the Target cashier when I shrieked ?OMG!? in the middle of the grocery store last week before nearly leaping over the conveyor belt to get to the other lane.

    ?Kerry Washington is on the cover of Women?s Health.? I yelled behind me once I reached the magazine rack. I waved the magazine around triumphantly, ?They never put Black people on the cover of fitness magazines!? I?m sure I said that loud enough for everyone around us to hear, but what do I care? It?s the truth.

    I love print magazines and I?m subscribed to at least seven different ones, three of which are fitness and health based. However, lately I?ve been letting my magazines subscriptions expire. Why? Because the racial makeup of our country is changing yet if you let the covers of these popular fitness magazines tell it, the United States is as White as ever.? Month after month the glossies that land in my mailbox fail to feature any women of color.

    Just this month when I spotted Cindy Crawford on the cover of December?s Shape Magazine, all I could think about was how many Black people in Hollywood they passed over to pull Crawford out of the archives.

    I get it. She?s a supermodel who graced the cover in 1992 and this new cover is commemorating her 20th year anniversary. Congratulations. However, this is also evidence that magazine editors still believe that a White celebrity whose heyday was two decades ago can sell more magazines than a Black celebrity who is having her moment right now. It?s sad?and it?s ridiculous.

    Magazines in general rarely put Black women on their covers, I know that. Vogue Magazine has had maybe 25 total out of the more than 400 covers ?in its entire history. However, I take special issue with the fact that Black women are underrepresented in fitness magazines because it just furthers the false narrative that Black women do not value their health. ?It seems as though if it weren?t for ?Black Girls Run?, the mainstream media would think the only African-American runners are the Women?s US Olympic 4?400 Relay Team (none of which have covered a health magazine this year, by the way).??These magazines play a powerful role in defining and?depicting female health and fitness and they?ve largely left minorities out of the picture.

    Of course it?s not totally accurate to say Black women never cover fitness magazines. Jennifer Hudson, Mariah Carey and Jordin Sparks get magazine covers when they lose 1,000 pounds. Apparently, dramatic weight loss will trump race every time (so will being Rihanna). But what about the scores of Black celebrities who are the picture of health on a daily basis? Those women are ignored because mainstream magazine editors obviously believe that Black women cannot be an example of good health. They seem to believe you have to be White to value exercise and nutrition.

    Why do they believe that? Because apparently, they?ve bought their own story that they?ve been selling for years saying Black women aren?t healthy. Sure, the statistics say that Black women are more likely to be overweight, but people of color are not the only ones tipping the scales. The United States has an obesity crisis that includes people of all races ? even White people. However, viewing people as a group instead of as individuals (as Black people are often viewed by others) allows a few Gabourey Sidibes instead of Kelly Rowlands to represent the whole and therefore excuses these editors from acknowledging many Black women have the same commitment to fitness as White women.

    Clearly an obesity crisis is no reason to ignore anyone ? especially not if your publication is geared toward educating people about health. In fact, I wonder if these magazines began celebrating Black women who are interested in physical fitness and nutrition if more Black women would then be motivated to get in shape because they would see it?s not just the White girl thing that these magazines make it out to be.

    It?s not like showcasing Black women would be putting magazines ahead of the curve anyway. These publications already have diverse readership and it?s about time their pages reflected that. How ironic I read these magazines in the gym despite the fact that the editors don?t believe a woman like me goes to the gym.

    It?s difficult to feel bad for the dying industry that is print magazines when the industry is killing itself by refusing to get with the times. Fitness magazine editors need to take a look at their covers and ask themselves what mindset is contributing to the homogeneity and is their persisting ?no Blacks allowed? mentality worth losing more subscribers because many have just lost one.

    It's always the same. The two companies continue to play tit-for-tat with their patents around the world. Apple's so-called rubber-banding patent has been particularly contentious. It played a central role in a German injunction against Motorola and was invalidated by the USPTO. Now the bounce-back scrolling effect has given Cupertino an other feather in its cap in the Netherlands. However, the Dutch court has chosen to be much more measured in its doling out of punishment. There will be no injunction, instead the manufacturer will be given eight weeks to update the offending handsets -- anything running Gingerbread or Froyo. Newer versions of Android, namely Ice Cream Sandwich and Jelly Bean, use a subtle blue glow to indicate the end of the line. For every day longer than eight weeks it takes to either issue updates or remove the aging devices from the market Samsung will be fined $100,000, but Lee Kun-hee has probably lost more cash than that in his couch cushions. Next week we're sure this same patent will be thrown out the window by French officials or Apple will be found to violate some Motorola patent... and around we go.

    People are lining up for Wii U launch in London

    The European Wii U launch is just a few days away, and some have lined up for a midnight launch event in London.

    Wii U londonThe Wii U launches in Europe on November 30, just a few days from now. And as expected, the first few people are already in line. A group of Nintendo fans have queued up in London to be one of the first ones to get the new Wii U console.

    And it?s a good idea to get in line: Nintendo has said that Wii U supplies in the UK will be limited, and some have estimated that only about 25,000 Wii U consoles will be available on launch day. Several UK retailers have recently said that they could not guarantee Wii U pre-orders.

    UK retailer HMV is holding a midnight launch event in London, where the first 100 people will receive a free copy of New Super Mario Bros U and a Wii U goodie bag. But besides the first 100, it?s unclear how many consoles are in stock for those looking to buy one on launch day.

    The Wii U sold 400,000 units in North America during its first week on the market. It would have sold more, but inventory was severely limited. The new console launches in Europe on November 30 and in Japan on December 7.

    Animal rights group sues California restaurant over foie gras ban

    LOS ANGELES (Reuters) - The animal rights group PETA sued a California restaurant on Wednesday that it says serves outlawed foie gras to patrons, in what appears to be the first lawsuit to enforce a state ban on the delicacy, PETA officials said.

    People for the Ethical Treatment of Animals said that Hot's Kitchen claimed to have stopped selling foie gras when a ban on producing or selling it took effect in July, but was offering it as a complimentary side dish to customers who order "THE Burger."

    "It's a transparent attempt to evade the law, plain and simple," said Jeff Kerr, general counsel for PETA. He said the suit was filed on Wednesday in Los Angeles Superior Court.

    The Hermosa Beach restaurant's online menu lists "THE Burger" as including balsamic thyme onions and whole grain mustard, and says it is served "with a complimentary side of foie gras."

    Foie gras is the swollen liver of a duck or goose that has been excessively force fed. It is prized for its flavor and rich texture, but animal rights groups contend that the force-feeding process is painful, gruesome and inhumane.

    California lawmakers banned the sale or production of foie gras in 2004 under penalty of a $1,000 fine per sale, per day. The law gave restaurants and farmers a years-long grace period that ended July 1 to implement the ban.

    Most restaurants removed the item from their menus when the law took effect. However, some reportedly left foie gras on the menu after the ban.

    In a widely reported act of rebellion, the Presidio Social Club in San Francisco served foie gras sliders to a crowd as protesters amassed outside. The owners contended the social club was not subject to the state law because it was on federal land, but the restaurant later pulled foie gras from its menu.

    Hot's Restaurant Group, of which Hot's Kitchen is a part, has been at the forefront of a charge to overturn the law, and sued California in federal court the day after the law went into effect, calling it unconstitutionally vague.

    "The statute defines 'force feeding' as using a process that causes a bird to 'consume more food than a typical bird of the same species would consume voluntarily,'" according to the legal complaint filed by Hot's Restaurant Group and a Canadian non-profit.

    "In practice, the vagueness of this purported standard makes it impossible for anyone to know at what point a particular bird has been fed 'more food' than the bird feeding law allows."

    The restaurant's spokeswoman, Kelley Coughlan, said the restaurant had so far not been served with the suit.

    "Publicity stunts such as the filing of an outrageous, baseless lawsuit, followed by the issuance of press releases are nothing more than an attempt to exploit the media by stoking controversial flames and are designed to line the pockets of profiteers," she said.

    "Hot's stands by its previous statement that foie gras can be made humanely, and we continue to provide our customers with wholesome, humane animal products."

    California Attorney General Kamala Harris is defending the foie gras ban, according to spokeswoman Lydia Gledhill.

    Gledhill said she was unaware of any legal action against purveyors of enlarged bird liver since July, but that the state wasn't formally tracking the law's enforcement.

    EPA: 1st phase of Ind. plant cleanup nearly done

    MISHAWAKA, Ind. (AP) ? Federal officials say crews have nearly finished initial cleanup work at a vacant northern Indiana plant hit by a September chemical fire.

    The U.S. Environmental Protection Agency said Friday that crews will complete the first phase of their cleanup next week at the Baycote Metal Finishing site in Mishawaka. The EPA began a federally-supervised cleanup at the former chrome-plating and metal-finishing plant in May.

    Since then, about 84,000 gallons of hazardous chemicals and metals have been removed.

    A September chemical fire at the site temporarily forced thousands of Mishawaka residents from their homes. That fire began when a contractor placed chemicals too close together at the site.

    Crews are suspending work at the plant site for the winter, but will resume the cleanup in the spring.

    One Direction makes Billboard history, holds off Aguilera, Del Rey

    LOS ANGELES (Reuters) - British boyband One Direction made Billboard chart history on Wednesday after storming to the top of the 200 album chart with their second album "Take Me Home," holding off competition from Christina Aguilera, Soundgarden and Lana Del Rey.

    "Take Me Home" notched the third-biggest opening week sales of the year with 540,000 units sold according to figures from Nielsen SoundScan, placing it behind only Mumford & Son's "Babel" and Taylor Swift's "Red," which had the year's biggest opening with 1.2 million copies sold.

    This is also the first time a British band have seen their first two albums debut at the top of the U.S. Billboard 200 chart. Their first album "Up All Night" shot to the top of the chart with 176,000 copies in March this year.

    The lead single from "Take Me Home," "Live While We're Young" also made Billboard chart history after selling 341,000 copies in its first week, becoming the biggest opening week single sales for a non-U.S. artist.

    One Direction were able to trump a new release from pop star and "The Voice" judge Aguilera, who debuted at No. 7 with her fifth studio album "Lotus," selling 73,000 copies.

    She was unable to replicate the success of fellow "Voice" judge Adam Levine, whose band Maroon 5 shot to No. 2 on the album chart in July with "Overexposed," selling 222,000 copies.

    The members of the British-Irish quintet One Direction, aged between 18 and 20, are Harry Styles, Niall Horan, Zayn Malik, Louis Tomlinson and Liam Payne. They have come a long way since forming on Britain's "The X Factor," coming in third place and going on to conquer the U.S. and build a devoted following of fans.

    Their success has also piqued the curiosity of interviewer Barbara Walters, who will be speaking to the band for her annual "The 10 Most Fascinating People," airing on ABC on December 12.

    The band will face stiff competition from R&B star Rihanna for the top spot on the Billboard 200 chart next week, as her new album "Unapologetic" is set for a big debut.

    Elsewhere on the album chart, seven new debuts entered the top 10 this week.

    Taylor Swift's "Red" was knocked down to No. 2 by One Direction's debut, while the soundtrack for the final "Twilight" film, "Breaking Dawn - Part 2," debuted at No. 3 with sales of 93,000 after the film hit theaters last week.

    The soundtrack features lead single "The Forgotten" by Green Day and songs by Passion Pit, Ellie Goulding, Fiest and a duet between "Twilight" cast member Nikki Reed and husband Paul McDonald, a former "American Idol" finalist.

    Canadian R&B star The Weeknd landed at No. 4 this week with his hotly anticipated debut, "Trilogy," while 1990s grunge rock band Soundgarden rounded out the top five with "King Animal," their first album in 16 years.

    Green Day's "Dos!," the second installment of their trilogy of new albums this year, came in at No. 9 on the chart with 69,000 copies, a big drop from their first album "Uno!," which debuted at No. 2 in October with sales of 139,000 copies. The third installment, "Tre!," is due out on December 11.

    Indie-pop songstress Del Rey rounded out the top ten with her latest studio set "Paradise," an eight-song record which was also offered as part of a deluxe edition of her debut album "Born To Die," which notched No. 2 on the chart in February.

    Finding Your Way to a New Venue. | Weisberg Law P.C.

    Lay et al. v. Bumpass, CA: 3:11-CV-1543 (M.D.P.A. 2012) is a case which examines the correct place to file a complaint for legal malpractice. This particular decision was based in part on the filing of the complaint in the Middle district of Pennsylvania based on diversity, meaning the plaintiffs were citizens making an allegation against a Defendant from a different state. The facts of the case are below.

    Originally, Plaintiffs werePennsylvaniaresidents who alleged an injury based on the negligence of TSA. As a result, their claim was required to be filed under the Federal Tort claims act. The injury form negligence occurred inArkansas, and the Plaintiffs hired anArkansaslawyer to handle the case.

    The Plaintiffs alleged that theArkansasattorney, representingPennsylvaniacitizens committed malpractice by failing to follow the standards of the act. Namely, the attorney failed to timely provide notice as required by the FTCA. Thus when Plaintiffs made their claim it was rejected by the TSA due to a violation of the statute of limitations. Plaintiff initiated this malpractice suit after the personal injury suit was rejected for being untimely. The defendant moved to dismiss the case for improper venue in the Middle district of Pennsylvania. The Plaintiff?s main argument that the suit should have been in the Middle district were that 1) the dismissal of their personal injury suit occurred in the Middle district, thus it is the place of injury and 2) all of their experts and evidence were located in the Middle district of Pennsylvania. The court dismissed both arguments. The main problem according to the court is that the FTCA sets out what should be used as venue in a personal injury case. Plaintiffs were alleging malpractice based on the personal injury case representation which is why the court went to the statute. According to the FTCA venue is proper where in the judicial district where the plaintiff resides or wherein the act or omission complained of occurred.

    However, that governs the personal injury suit, not the legal malpractice. Thus the court had to go to tort law as opposed to federal law. The venue in discussion in this case was that of the legal malpractice case. There was not a challenge to the venue of the FTCA claim, since by statute that could have been prosecuted inPennsylvania. The Middle district adopted the same rule other courts used that venue is proper in the county where the negligence arose.

    In this case, the Plaintiffs got in the door to Federal court based on diversity. Where jurisdiction of the Federal court is based on diversity, the court recognized that by statute the case may be brought in any district where the defendant resides; any district where a substantial part of the case took place; or any district in which any Defendant is subject to personal jurisdiction.

    It was uncontested that Defendant did not reside inPennsylvaniathus, that rule was crossed out by the Court. Ditto for personal jurisdiction. Personal jurisdiction did not apply because the attorney fromArkansasdid not do any advertising inPennsylvania. Thus that left only the district where a substantial part of the events occurred.

    The Court was then tasked with deciding what district that was for purposes of this case. To establish where the Plaintiffs were when the action occurs in a legal malpractice case involves analyzing the relationship between attorney and client. Based on precedent the court established that a telephone call to a client or a mailing does not establish venue. Neither does the fact that tortuous conduct occurs in one venue when the harm is felt in another. Thus both of those took out specific parts of Defendant?s conduct which caused harm to Plaintiffs. The court could not find acts of the Defendant which also gave rise to venue.

    At this point, Plaintiffs were out of ammunition, because a finding of personal jurisdiction would have been a due process clause question which is an article for another day. Plaintiffs hired anArkansasbased attorney to prosecute their claim, thus the court found there was no intentional relationship withPennsylvania. Additionally, all aspects of representation occurred inArkansas, thus the court transferred the case accordingly.

    The reason Plaintiffs seek to file in certain courts is based on remedies. While this case may seem to have been an open and shut instance of filing in the wrong venue, Plaintiffs attorney was attempting to utilize the strategic advantage Plaintiffs gain in his view. While it was unsuccessful, it is important to keep in mind the three ways a diversity suit may come under the auspices of a court which would seem not to have an interest. This is increasingly important given the inter-connectivity in the computer age.

    Next pope an American? US cardinals a factor

    ROME ? The red, or rather scarlet, carpet will be rolled in St. Peter's Basilica on Saturday for the elevation of six cardinals. The new so-called "princes of the church" will receive their ring, scarlet skullcap and the traditional biretta, a four-cornered hat, in a solemn ceremony presided by Pope Benedict XVI.

    The ceremony won't only be a rare insight into one of the oldest and most colorful traditions in the Catholic Church, which with 1.1 billion adherents worldwide, represents more than half of the world's Christian population. It will also redefine the balance of power in the Catholic Church, and further increase the United States' influence in the election of the next pope.


    Among the six cardinal-elects is James Harvey, an archbishop from Milwaukee who will become the 11th cardinal elector from the U.S., strengthening the country's position as the Vatican's second-largest voting bloc after Italy. ?Cardinal electors are the members?of the College of Cardinals who have not reached their 80th birthdays on the day the pope dies and are thus able to vote for the new prelate.

    But as American author and John Paul II biographer George Weigel explains, the fact that American cardinals will represent almost 10 percent of worldwide electors in the next Conclave (the election of the pope), does not necessarily mean one of them will become the next Holy Father.?

    "The prominence of American cardinals in the current college reflects the vitality of the Catholic Church in the United States," Weigel told NBC News. ?But I don't think it likely that any American will be elected pope for as long as the United States remains the world's pre-eminent power."?

    What the selection of an American to be one of the new cardinal electors might show however, is that Pope Benedict XVI is acutely aware that the Catholic Church is swiftly ceasing to be?predominately?European religion.?After all, with 134 million followers, Brazil alone has more Catholics than Italy, France and Spain combined,?according to a major study released in 2011. Even the United States, with 75 million or ?24 percent of the world's Catholics, is far ahead of any European country.

    Harvey, 63, is a well-known and respected figure in the Vatican. He was named prefect of the papal household in 1998, and has since arranged daily meetings and engagements for Pope John Paul II first, and Benedict XVI later. Having lived for the past 30 years in the Vatican, he may be more familiar with the dome of St. Peter?s Basilica than the "Domes" at the Mitchell Park Conservatory, but he never severed his ties with his native city.

    Once he receives his ring, skullcap and hat on Saturday, Harvey will become the third American to be elevated to cardinal this year, after Edwin Frederick O?Brien and Timothy Michael Dolan received the honor back in February.

    "Cardinal Dolan is definitely a candidate and enjoys a lot of name recognition ? which helps in a global church," Alessandro Speciale, Vatican correspondent at the Religious News Service, told NBC News.

    "But two factors might weaken his chances: coming from the world's only superpower could still be seen as a negative factor in a global church, and he has never held a leadership position in the Roman Curia," he said,?referring?to the Holy See's?administrative?body. ?

    New York Cardinal Timothy Dolan, who is being touted as having a chance to become the first American pope, talks with MSNBC's Chris Jansing about the controversial immigration laws in Arizona and Alabama that allow law enforcement to check on the status of suspected illegal immigrants.

    In any case, the choice of non-Europeans to high office in the Vatican is?a way for the Holy See to shift the balance of power towards other continents and prove the ?universality of the church.??

    "There was considerable criticism of the last group of cardinals being too European, too Italianate, and too Curial. I think it's fair to read this group as a response to that criticism," Weigel said.

    Speciale agrees: "The previous Consistory in February had been criticized for being overly skewed towards Italy (and more in general Europe) and, again, the Curia. With this quite unusual second batch of red hats in a year, Benedict wanted to show his attention to the rest of the world."

    Whatever the reason for the choice of non-European Cardinals, the selection plays in favor of the American grouping, which will have one more elector in their ranks.

    "The power of Americans in the Vatican has grown significantly in the last few years: not just because of the star power of Cardinal Dolan but also thanks to the organization, economic resources and boldness in the defense of Catholic values in front of a perceived hostile society is admired by many in the Vatican," Speciale said.

    "But it remains to be seen whether this numerical weight will actually translate into influence at the Conclave: though national links are powerful, many other factors ? the strongest being whether one is part on not of the Roman Curia ? play into the secret voting in the Sistine Chapel."

    When the time comes, all Cardinals-electors from all over the world will "lock" themselves in the Sistine Chapel in order to vote for a new Pope. While it is unclear who will emerge from it as the new leader of the world's Catholics, one thing is certain: that American influence in that choice went up a notch.

    Friendship turned into relationship?

    Well basically I was friends with this girl for about three years and at the end of secondary school I had my debs (or prom or whatever you wanna call it ) and decided to ask her to go with me. From then on we started meeting up more and more until one day I realized I actually fancied her.     France eyes Middle East influence, image with Syria gamble

    PARIS (Reuters) - President Francois Hollande's decision to recognize Syria's new opposition bloc aims to secure long-term French interests in the region and boost his foreign policy image but, with few allies following suit, Paris may risk isolation.

    With his economic policies under harsh scrutiny at home and abroad, Hollande's hesitant response to the Syria conflict before last week had been unflatteringly compared to the decisive approach of predecessor Nicolas Sarkozy when he led Western efforts to oust Libyan leader Muammar Gaddafi.

    Breaking with allies and the Arab League, Hollande took a leaf out of Sarkozy's book last week by recognizing the Syrian National Coalition and backing it to replace President Bashar al-Assad's government. He said France would even study arming rebels waging a 20-month-old uprising to topple Assad.

    The move, he hopes, will hand Paris a decisive role in shaping Syria's future and give his sagging approval ratings a boost with a show of decisive statesmanship.

    "Hollande was accused of not being Sarkozy's equal so he wants to show he is capable of dynamic foreign policy," said Denis Bauchard, who was the foreign ministry's Middle East director in the 1990s.

    "We are trying to help put in place a stable democratic government so it shows Arab public opinion that this region remains a priority for us and we want to play a major role."

    Previous efforts to unite the opposition under the umbrella of the Syrian National Council ultimately failed after widespread accusations that the SNC had little sway within Syria and was dominated by the Islamist Muslim Brotherhood.

    Paris is concerned that the window to unite the opposition is disappearing and the longer disunity prevails the more likely jihadist and al Qaeda elements, hostile to the West and now among the insurgents fighting Assad, would emerge on top.

    "If we miss the opportunity to restructure the Syrian opposition, we can't shed crocodile tears afterwards saying it's descending into chaos," a French diplomatic source said.

    "We don't think it's in the interests of Syria, the region, the international community or France to have radical Islamists changing the dynamics in Syria."

    The new coalition, led by moderate Sunni Muslim cleric Mouaz Alkhatib, who met Hollande in Paris on Saturday, is more inclusive of minorities from a country of great ethnic and religious diversity. The SNC makes up a third of the new group.

    GAMBLE ON THE UNKNOWN

    Hollande is running the risk, however, that this new coalition may not win broad international backing in the end and meet the same fate as the SNC, which has gradually unraveled as the main opposition movement despite French support.

    Hollande's decision took many by surprise given that the new Syrian National Coalition has yet to prove itself on the ground. Questions remain among France's allies over how representative it really is of the Syrian people and what values it stands for.

    Unlike Libya's rebellion against Gaddafi last year, the Syrian coalition still lacks a clear unified military command. There is no consensus at the United Nations Security Council for a military operation to support it, and neither Russia nor China are ready to withdraw support for Assad.

    "Hollande has the political ambition to make Syria his own Libya by supporting the new coalition but beyond the rhetoric there hasn't been any real change in the French position," says Ahyam Kamel, Syria analyst at consultancy Eurasia.

    "I think it has already backfired. France is really alone on this as its partners do not yet see eye-to-eye on it."

    At a meeting in Brussels on Monday, European Union foreign ministers said they deemed the new coalition to be "legitimate representatives" of Syrians but stopped just short of giving the full recognition as France itself has done.

    French officials are adamant that the likes of the United States, Britain and the Arab League will soon come around.

    But other Western states are uneasy over the presence of radical Islamists among the rebels and accusations by U.N. investigators of war crimes committed by insurgent fighters.

    As the former colonial master in Syria, it makes sense for France to be a leader in solving the crisis and its economic ties with Assad's government have been modest in recent years.

    By positioning itself now for the long term, Paris hopes to reap the business rewards from Syria's reconstruction.

    "There is a long-term benefit if things go well. They can have more leverage on the new government and influence whatever transition takes place," said a Paris-based Arab diplomat.

    There is also a threat to Lebanon, where France has its strongest political and economic links in the region and where 1,000 French troops are stationed in a U.N. peacekeeping force.

    Since the assassination last month of Lebanon's top security official, Paris is increasingly alarmed by a spillover of violence from Syria. Hollande warned on a visit to Beirut this month that he would oppose those stoking instability in Lebanon.

    "It's not only about the worsening situation in Syria but about contagion to countries that are important to us, especially Lebanon," said a French diplomat. "When Hollande went to Beirut that risk was spelt out to him."
